Obama Muslim Smear Resurfaces: NYT Op-Ed Tags Obama As Muslim 'Apostate'- Huffington Post
When the Islam smear against Obama first came out, it was based on the idea that he is currently, a Muslim.
Then the Pastor Wright controversy put that mess to rest, since Obama's affiliations to an obviously Christian Church became front and center.
Now there is a new Islam smear. This one says that Obama was a Muslim -- and as a result, he is going to arouse the wrath of Muslims around the world who are going to want to kill him for apostasy (converting away from Islam, punishable by death).
This new version comes to us via Edward Luttwack in the New York Times.
Luttwack says:
As the son of the Muslim father, Senator Obama was born a Muslim under Muslim law as it is universally understood. It makes no difference that, as Senator Obama has written, his father said he renounced his religion. Likewise, under Muslim law based on the Koran his mother's Christian background is irrelevant. *
With few exceptions, the jurists of all Sunni and Shiite schools prescribe execution for all adults who leave the faith not under duress; the recommended punishment is beheading at the hands of a cleric, although in recent years there have been both stonings and hangings.
There are fundamental problems with views like Luttwack's.
First of all, under orthodox Islamic law, the punishment for apostasy can only be carried out by the state. Luttwack, with his facile understanding of Sharia, clearly doesn't understand this. The clerics Luttwack is talking about can't just stroll up to Obama and stick him in the sand. They have to go through the established procedural norms of Islamic criminal law which is inherently tied to the functioning of a state apparatus. This means that a country like Saudi Arabia or Iran or Pakistan would have to indict Obama on apostasy charges in their courts. Obviously this is not going to happen, because none of these countries have jurisdiction over Obama. Not only is it asinine for any of these countries to make such an indictment, it doesn't make sense under international law -- which, in case Mr. Luttwack has forgotten, is what the world is suppose to abide by. Luttwack's affirmation of Islamic law over and above international law should raise concerns, not only about his expertise, but also his allegiances.

Firstly, apostasy can be carried out by the umma (community) since apostasy is stated in the koran as being to cause mischief in the land (among the faithful, in other words) and Muhammad's instruction re apostasy was given before there was any formal islamic state in place or a codified system of jurisprudence (Sharia law) and the 'community' is, in the ideal moslem world, the islamic state. Having said that, in islamic law, the following should correctly occur: the person suspected of apostasy, if an adult, must be 'invited' several times over to renounce his or her apostasy, so it is not simply a matter of murdering someone without some semblance of legalism (though in practice, this legal aspect does get ignored). A child is not considered guilty of apostasy or even tried for it, if the child left islam under the age of puberty, though I have read examples, too, of children who were no longer Moslem, being murdered. Also, the Cairo Declaration of Human Rights in Islam does not guarantee freedom of religion (or conscience) as is understood within the stated Western terms of the UN-promoted Universal Declaration of Human Rights (1948); the Cairo Declaration (1990) states that no one may induce a Moslem to leave Islam; in other words, it is not stated as a "right" but as a "restriction" and that Cairo Declaration does state (Article 24) that "All the rights and freedoms stipulated in this Declaration are subject to Islamic Shari'ah" and (Article 25) that "islamic Shari'ah is the only source of reference for the explanation or clarification of any of the articles of this Declaration." Muhammad said "Whoever changes his deen (islamic faith), then kill him." (Hadith of Bukhari Vol 9, Bk 88, No 6922).
